Guide · Find My Intern
Whether an internship should be paid depends on the arrangement. Here is a plain-English overview.
When unpaid can be OK
Broadly, an unpaid placement can be lawful in Australia when it is a vocational placement that is a required part of an approved course, or when there is no employment relationship, for example the main purpose is for the person to learn, not for the business to get productive work done.
When it should be paid
If an intern is doing productive work that the business benefits from, much like an employee would, they may be an employee and entitled to at least the minimum wage and other entitlements.
Where to check
The Fair Work Ombudsman has detailed guidance on unpaid work and internships at fairwork.gov.au. If you are unsure, ask the employer how the internship is set up, or contact Fair Work.
